Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD: a)Slurp Department, on or about 12/5/02: Manguard 1/4-ton hoist, support structure had an unknown load capacity rating. b)Sauce Maintenance, on or about 12/6/02: CM 1-ton hoist, support structure had an unknown load capacity rating. c)Juice Maintenance, on or about 12/6/02: Budgit 1/2-ton hoist, support structure had an unknown load capacity rating. d)Can Line Case Packer Area, on or about 12/10/02: Dayton 1/2-ton hoist, was mounted to a 300 pound capacity support structure. e)Juice Prep Area, on or about 12/10/02: Below the hook lifting device used to raise tote tippers weighing approximately 890 pounds had no load capacity rating. f)Slurp Department, on or about 12/5/02: Below the hook lifting device used to lift rolls of plastic weighing 250 pounds had no load capacity rating. g)Can Line Case Packer Area, on or about 12/10/02: Below the hook lifting device used to lift rolls of plastic weighing 287 pounds, including the spindle, had no load capacity rating. Among other methods, one feasible method of abatement is to determine the rated load capacity and mark the lifting device accordingly as per ASME B30.20-1993 and inspect the support structures for the hoists as per ASME B30.16-1993, to ensure the structure is designed to withstand the loads and forces imposed by the hoist for the rated load.
