Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD : a)North end of the New Tank Shop, on or about 06/19/2002: A Spreader beam, 12 foot long, with a lifting chain affixed to each end which had been locally designed and fabricated as a below-the-hook lifting device had no rated load markings and no inspections or external code mark record(s) was used to evaluate external conditions. b)Seam Welding Area, on or about 06/19/2002: A Spreader beam, 21 foot long pipe 4 1/2 inches in diameter, with three lifting chains affixed at the bottom and one lifting chain at the top which had been locally designed and fabricated as a below-the-hook lifting device had no rated load markings and no inspections or external code mark record(s) was used to evaluate external conditions. c)Circle Shear, on or about 06/19/2002: Two Spreader beams, one 12 foot long and one 8 foot long both 4 inch square hollow tubes, with lifting chains attached to each end which had been locally designed and fabricated as below-the-hook lifting devices had no rated load markings and no inspections or external code mark record(s) was used to evaluate external conditions. Among other methods, feasible and acceptable methods to correct each of these hazards are to: 1.Rate and mark the load capacity of the lifting devices on a tag/plate or equivalent. Section 20-1, ANSI/ASME B30.20-1993, Below-the-Hook Lifting Devices. 2.Conduct frequent and periodic inspections of the lifting device in accordance with Section 20-1, ANSI/ASME B30.20-1993, Below-the-Hook Lifting Devices.
