Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: THE HAZARD OF BEING STRUCK-BY a falling truck body or spool of welding wire: a)Assembly Jig Line 451, on or about 02/07/2002: One body lift cradle used to lift and move partially assembled truck bodies weighing from 1000 to 5000 pounds which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. b)Assembly Jig Line 351, on or about 02/07/2002: One body lift cradle used to lift and move partially assembled truck bodies weighing from 1000 to 5000 pounds which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. c)Assembly Jig Line 251, on or about 02/07/2002: One body lift cradle used to lift and move partially assembled truck bodies weighing from 1000 to 5000 pounds which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. d)Shipping Department, on or about 02/07/2002: One body lift cradle used to lift completed truck bodies weighing from 3000 to 5000 pounds which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. e)Assembly Jig Line 451, on or about 02/07/2002: One frame lift used to lift and move body frames with cross-members which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. f)Assembly Jig Line 351, on or about 02/07/2002: One frame lift used to lift and move body frames with cross-members which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. g)Assembly Jig Line 251, on or about 02/07/2002: One frame lift used to lift and move body frames with cross-member which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. h)Assembly Jig Line 251, on or about 02/07/2002: One Weld Wire Lift Rig used to lift and move welding wire spools weighing 1000 pounds which was an internally designed and manufactured below-the-hook lifting device had no load test rating, rated load markings and inspections were not performed. i)Plate and Sheet Area, on or about 02/06/2002: Two Cady lifters, 5 ton,Asset numbers: NY-20023 and NY-20024, below-the-hook lifting devices used to lift and move plate and sheet metal had no frequent or periodic inspections performed. Among other methods, feasible and acceptable methods to correct each of these hazards are to: 1.Load test, rate and mark the load capacity of the lifting device on a tag/plate or equivalent area on the device in accordance with ANSI/ASME B30.20- 1993, 20-1.2 2.Conduct frequent and periodic inspections of the lifting device in accordance with ANSI/ASME B30.20-1993, 20-1.3.1. Abatement certification must be submitted for these items.
