40.1-51.1(a) of the Code of Virginia: The employer, Virginia Department of Game & Inland Fisheries, did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and/ or lacerations from falls that could occur when they have to work outdoors in the dark, around concrete fish tanks and spillways. At the Montebello Fish Hatchery, Montebello, VA., employees are exposed to falling into/onto fish holding tanks while feeding and stocking in the dark. The hatchery is not equipped with outdoor lighting of sufficient illumination for employees to see to travel. One feasible and acceptable abatement method, among others, to correct this hazard is to equip the hatchery outside areas with adequate illumination for employees to work at night. A recognized standard for lighting in the workplace can be found in ANSI/ IES RP-7, 1983.
