Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck or crushed by moving equipment and moving loads: a.Lot 27 Dove Road, Hooksett, NH - Employee was exposed to the hazards of being crushed or struck by a moving excavator and a moving load which were transported in close proximity to an employee performing site clearing work on or about March 8, 2002. ABATEMENT NOTE: One feasible means of abatement would be to ensure the danger area is absent of employees prior to swinging or moving of the excavator and load in any direction.
