Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to : Being crushed by unplanned building collapse. Construction site: Kings Highway and Coney Island Avenue, Brooklyn, N.Y. a) Employees were exposed to unplanned building collapse due to the fact that they worked doing demolition in a part of the building that the engineer stated should not have any demolition work done, on or about 5/11/01 through 7/3/01. One feasible means of abatement would be to follow the May 11, 2001 engineering survey letter`s requirements, and do not do any demolition in the part of the building above the retail stores until the retail stores are vacated and the engineer has an opportunity to survey these areas to determine the possibility of unplanned collapse. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
