5(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees working at the nitrogen tumbler or walking to the conveyor loading area were exposed to the hazard of metal extrusions which can fall from the overhead paint line conveyor. The conveyor did not conform to ASME B20.1- 2000 which states in relevant portions: 5.9.2(d) Although overhead conveyors may be guarded by location, spill guards, pan guards, or equivalent shall be provided if material may fall off the conveyor and endanger personnel. Note: Feasible and acceptable abatement methods include, but are not limited to, the following: 1) Install guards below the conveyor to catch any material that falls from the conveyor. 2) Eliminate employee exposure to the hazard by installing fences or guardrails so that employees do not walk or work in any of the danger areas below the conveyor.
