Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being pinned under, crushing, or thrown from a forklift during an accident with the fork truck due to not wearing the seat belt provided: as required in ASME B56,1-1993. a)Yard Area: an employee of Wyde Lumber Company was operating a Hyster fork truck without wearing the seat belt. Among other methods, one feasible and acceptable method to correct this hazard is to train employees and ensure employees to use the seat belts provided when operating a forklift truck as referenced in ASME B56.1-1993.
