Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to employees in that the employee was exposed to: (a) The hazard of possible unexpected movement of the machine and/or the load due to the operator being more than 25 feet from the controls of the forklift while the forks were elevated with personnel on the platform. Among other methods, one feasible and acceptable method to correct the hazard would be to follow the guidelines set forth in ASME B 56.6 1992, Safety Standard for Rough Terrain Forklifts for a safety platform and to keep the operator within 25 feet and visual contact with the controls.
