Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling objects. On or about 8/12/02, an employee was struck by a caterpillar stick cylinder when the rigging suspending it failed. Deficiencies in the rigging used to hoist the Caterpillar stick cylinder include but are not limited to: a). Malleable clips were used on the hoist rigging. b). The safety latch was missing on the block hook. c). Sizzle rope not approved for lifting was used for sling around the cylinder piston. d). The hoist and rigging equipment had not been inspected by a person competent in rigging standards. Among other methods, on feasible and acceptable method to correct this hazard is to establish, enforce and comply with rigging and sling standards 1926.251 and ASME B30. 16-1993. 1. ensure that forged clips are used on wire rope. 2. Ensure that the safety clip is not broken and/or missing. 3. Ensure that an approved sling is used around the materials being lifted. 4. Ensure that the hoist used to lift has been inspected prior to being used, and the equipment is rated to support all loads imposed.
