Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: hazard of being struck by coke, steam and hot water from coke pit. Coke Pit - Employees of Structural Preservation System, Inc. on December 4, 2002 were working on the west wall of the coke pit opposite Coke Drum B as it was dumping coke. Employees were exposed to the hazard of being struck by coke, steam and hot water from the coke pit during the dumping of coke. Among other methods, one feasible and acceptable method to abate this hazard is to follow the Job Aid, Securing Coke Pit Walls for Construction Work, by preventing employees from working in front of Coke Drums A, B and C when Coke Drum B is being dumped.
