Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: death by crushing while operating a powered industrial truck whose seat belts had been removed. (a)At the North Building - Employees operating the Clark powered industrial truck, Model #C500-S80, S/N 685-0040-4451, were exposed to injury because seat belts had been removed from the Operator's seat. Among other methods, one feasible and acceptable abatement method to correct this hazard is to contact a Clark Powered Industrial Truck distributor and order a set of seat belts; then have them installed.
