Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being struck by falling pieces of concrete piling. (a) Petal Bypass - Employees on September 18, 2001 were allowed to check the alignment of concrete piling while the concrete pilings are being driven into the ground with a 10,666 pound ram (hammer). Among other methods, one feasible and acceptable method to correct this hazard is to not allow employees to check the alignment of the concrete piling while the concrete piling is being driven into the ground.
