Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: the hazard of electrical burns. (a)U.S. Highway 61 North, 3.5 miles North of the Issaquena-Warren County Line - The employer allowed employee(s), who were setting new 40 foot, Class C-1 pole(s) into the existing Yazoo Valley Electric Power Association's live, three- phase, 13,200 Volt, "Valley Park" electric power distribution line, to be exposed to burns from contact with energized components while not wearing a flame- retardant-treated shirt, or an untreated 100cotton shirt of the appropriate weight for the electrical exposure encountered. Among other methods, one feasible and acceptable method to correct this hazard is to: 1.require employees exposed to energized electric equipment to wear flame- retardant-treated clothing (shirt & pants), or untreated 100cotton clothing of a weight appropriate for the flame and electric arc conditions expected, and 2.require foremen to inspect employees' clothing prior to employee exposure, or 3.otherwise, enforce the flame-retardant-treated clothing usage policy.
