Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or are likely to cause death or serious physical harm to employees; in that an employee was permitted to ride on the step above the tracks of a JOHN DEERE, Model 270LC, Hydraulic Excavator, exposing the employee to the hazard of being struck by, crushed by, or thrown off the hydraulic excavator: (a)City of Fulton, Mississippi, Surface Water Supply - Phase 1, Spring Street Extension Area - An employee was not protected from the hazard of being struck by and/or crushed by a hydraulic excavator. The employee was permitted to ride on the step above the tracks of a JOHN DEERE, Model 270LC, hydraulic excavator, while the excavator was digging an excavation. Among others, one feasible and useful abatement method to correct this hazard is to: (1) Follow the requirements of the Operator's Manual for the John Deere, Model 270LC Excavator. Section 5, Safety, Page 05-11, 'Keep Riders off Machine', states, "Only allow the operator on the machine. Keep riders off. Riders on machines are subject to injury such as being struck by foreign objects and being thrown off the machine."
