Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to being struck by a portable mortar mixer that was not secured: Job Site: Garage area. Employees were exposed to being struck by a portable mortar mixer whose wheels had been removed and was supported on blocks of concrete and lumber that were unstable. One method of abatement among others would be to re-install the wheels and chock them to prevent the unit from displacement.
