Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees. Specifically, On the four 4,000 lb. capacity monorail hoists at the infeed end of the four "Tubing" machines: a)The hoist upper limit switch was not tried out under no load at the beginning of each operator's shift - with extreme care exercised as the block is "inched" into the limit or run in at slow speed. b)The hoist limit switch which controls the upper limit of travel of the load block was used as an operating control when loads were carried over paper rolls or other objects, and when storing the hoist when not in use.
