Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to laceration/amputation hazards: (a) Plant, Maintenane Area- Provision was not made to prevent industrial machinery, including but not limited to, the chop saw from automatically restarting upon restoration of power after a power source failure. Among others, one method of abatement is to equip the machinery with an electrical device that is designed to prevent automatic restart after power has been restored to require operating levels, as prescribed in NFPA-79, Electrical Standard for Industrial Machinery, Section 8. Abatement documentation is required for this item in accordance with 29 CFR 1903.19 paragraph (d).
