Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall-related hazards when accessing a change in work surface elevation. Or in the alternative: 29 CFR 1910.37(j): Changes in Elevation. Where a means of egress is not substantially level, such differences in elevation shall be negotiated by stairs or ramps. Fifth Floor, Boiler Unit #1, East and West Sides Employees lowered themselves through openings in the fifth floor grating onto ventilation ductwork located approximately 57-58 inches below the fifth floor, in order to perform maintenance work related to the installation of an acoustic air horn system. There were no stairs leading from the fifth floor to the ductwork below. A ladder was not used. Some feasible means of abatement would include compliance with: a)OSHA's construction industry standard 29 CFR 1926.1051(a) which states "A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment or personnel hoist is provided" or b)NFPA Life Safety Code 101, 1994 Edition, 5-1.6.1 Changes in Level in Means of Egress which states "Changes in level in means of egress shall be by a ramp or a stair where the elevation difference is more than 21 in.(53.3 cm)."
