Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Employees were being exposed to the hazard of being struck, and or crushed by, a moving Mack Truck with a McNeilus hopper. An employee who was acting as a spotter/signal man walking behind the truck while it was backing up, was crushed between the truck and a tree. Violation occurred on or about 11/28/00. One method of abatement, among other feasible methods, is to: 1. Review with and distribute to drivers and lifters the National Solid Waste Management Association (NSWMA) Manual of Recommended Safety Practices for backing safely, acting as a spotter during backing and working around mobile equipment. i.e. a. Provide small compressed gas horns, worn on the belt that can be sounded if the worker trips or falls in the path of a backing vehicles. b. Two way radios to communicate with the driver. c. Supplement the rear view mirrors with convex mirrors mounted at the rear corners to provide vision across the back of the vehicle. d. Infrared or ultrasonic sensing units to detect persons or other objects in the path of a backing vehicle. 2. Enforce the Backing Operations Memo dated 12/07/01 and to establish a frequent and regular worksite program to ensure employees comply with this rule. ABATEMENT VERIFICATION IS REQUIRED within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
