Section 5a(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries in the event of a forklift tip-over accident because of lack of operator restraint devices. Among other methods, one feasible and acceptable means of abatement to correct this hazard would be to install seat belts and require the use of same on all forklifts that contain an overhead guard: GARAGE: CLARK FORKLIFTS, SER 355-570-2504; SER 355.2595.2572; SER G138MB-0105-6963KOF; AND SER G138MB-0417-6410FA LACKED AN OPERATOR RESTRAINT DEVICE.NT
