Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing injuries from being struck-by trailers in tow, upon falling off of moving flatbed trucks, while attempting to retrieve empty cardboard boxes, on or about 02/02/01. a)Strawberry Field Six West - GMC 3500 HD Flatbed Truck & Strawberry Trailer in Tow Employees climbing and riding the rear of moving flatbed trucks with strawberry trailers in tow, which were not designated, designed or intended for passenger use, in order to obtain empty boxes for strawberry picking and packaging, on or about 02/02/01. ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO: 1) Follow the Florida Criminal and Vehicle Handbook, Section 316.2015. Unlawful for person to ride on exterior of vehicle, Paragraph (2), which states, " No person shall ride on any vehicle upon any portion thereof not designed or intended for the use of passengers". "ABATEMENT VERIFICATION IS REQUIRED"
