Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees from falls when using an oversized, or a platform not rated for loads on a rough terrain truck: Elevated work platforms used with Rough Terrain Forklift Trucks as designated by the manufacturer must meet design, construction, and use requirements as outlined by ASME B56.6 Safety Standard for Rough Terrain Forklift Trucks section 8.24 and other acceptable industry practices. a) On or about April 16, 2003, Employees of Jeff Nygaard Construction worked in an elevated platform suspended by the Pettibone lift which did not meet the design and use requirements of ASME B56.6 in the following areas: 1) The platform dimension exceeded in width, more than 10 inches than the overall width of the truck. 2) The guardrail around the upper periphery was incomplete. 3. The platform did not have the maximum work load and empty weight information prominently marked. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate methods such as the use of a scaffold or a platform approved by the manufacture meeting the requirements of ASME/ANSI B56.6-2002 for attachments on rough terrain forklifts. Abatement Certification and Abatement Documentation required.
