Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to pinch point hazards: a.On or about November 15, 2002, the buck-hoist operators were exposed to pinch point hazards during inspections and maintenance of the buck-hoist. Among other methods, a feasible means of abatement would be: 1. During hoist inspections and maintenance, the hoist must be operated from the cage of the roof with the control box. 2. Under no circumstances shall the hoist be operated if there is a person within the ground enclosure, on the mast or tie-in. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
