Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a falling hazard: a.On or about June 5, 2002, the employer did not ensure that limited travel distances (less than 2/10th of a mile) and slower speeds (no more than 10 miles per hour) were maintained when employees (throwers) were being transported on the outside riding steps on Truck 173, in that the truck traveled a distance of 8/10th of a mile at a speed that was estimated to be 19 to 38 miles per hour between 6142 Golden Oak Lane and 6303 Golden Oak Lane, exposing throwers to falling from the riding steps. Among other methods, one feasible and acceptable method to correct this hazard is to enforce compliance with American National Standard for Refuse Collection, Processing and Disposal Equipment, Mobile Refuse Collection and Compaction Equipment Safety Requirements, ANSI Z245.1-1992 6.2.4 by ensuring that no persons ride on steps when the vehicle is exceeding 10 mph or operating in reverse or when the distance travelled exceeds 2/10 mile. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
