Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a motor vehicle: a.On or about July 19, 2001, the employer did not ensure that the backup alarm on the fertilizer truck was distinguishable from background noises, exposing employees to the danger of being struck by moving equipment due to an obstructed view to the rear. The back up alarm was not distinguishable from background noise (i.e., vehicle and airplane engine noise). There were feasible and useful methods to correct the hazard; a)Ensure reverse signal alarms of motor vehicles can be heard over the background noise of the loader and airplane. b)Develop policies to specify that drivers must stay in their trucks and/or in the designated areas. The designated area will be in an area away from vehicles (fertilizer loader) and be marked (e.g., with traffic cones, tape). e)Retrain drivers and support personnel about the hazard of working in the proximity of the loader, and the policies above.
