Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not trained to wear seatbelts while operating powered industrial trucks: (a)Facility-wide: On November 26, 2001 and at times prior thereto, the employer failed to train powered industrial truck operators seatbelts when operating forklifts. AMONGST OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE THE USE OF SEAT BELTS WHEN OPERATING FORKLIFTS (POWERED INDUSTRIAL TRUCKS) THROUGHOUT THE ESTABLISHMENT AS REQUIRED BY ANSI/AMSE B56.1, PARAGRAPH 5.3.19. Note: Abatement certification required for this item.
