Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of trucks which were not properly maintained and could result in accidents in the yard: (A)Regular safety and maintenance inspections were not done on trucks resulting in employees operating unsafe vehicles. The International Harvester 16,000 pound capacity "Party Truck" license plate #KE608 had an inoperable parking brake in that the cable was broken off. Among other methods, one feasible and acceptable abatement method to correct this hazard is to conduct periodic safety and maintenance inspections of the trucks/vehicles and do the maintenance required to ensure the vehicles are safe to operate.
