Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from an aerial lift: On July 16, 2001, an employee was observed operating a Genie GS-1930 aerial lift and did not maintain a firm footing on the platform floor as required by the manufacturers operating manual and the American National Standard for Self-Propelled Elevating Work Platforms- ANSI/SIA A92.6-1990 paragraph 8.10.1. The employee climbed on and straddled the platform mid-rails and the top-rails to work on the structural steel assembly; thereby, exposing the employee to an approximate fall hazard in excess of 20 feet to the concrete floor.
