Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of working under suspended loads: (A)Shingle Prep: On or about 12 December 2000, and at times prior thereto, two employees were working under suspended loads of roofing paper. The operation of the overhead hoist was not in accordance with the American National Standards Institute (ANSI) B30.16-1987, Safety Code for Overhead Hoists, section 16-2.3.2.3.f. Note: Abatement certification required for this item. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO: Only hoist the load when needed, cordon off the area, and prohibit employees from entering the area below the load.
