29 CFR 1926.20(b)(4): The employer did not permit only those employees qualified by training or experience to operate equipment or machinery: (a) Vinings Place Drive, Mableton, GA, 1987 TR Ford dump truck VIN #1FDYU82A2HVA07571 - Employer did not ensure that employee who drives the truck was qualified and trained in the safe operation of the vehicle. Hazard of uncontrolled truck. Observed on or about April 25, 2001. Or in the alternative: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employee who was driving the dump truck was exposed to the hazards of a moving dump truck. (b) Vinings Place Drive, Mableton, Ga, on April 25, 2001 - An employee of Cornerstone Construction was driving a 1987 dump truck up a hill when the truck began to roll backwards, exposing the driver to an uncontrolled truck and exposing other employees to being struck by the truck. One feasible and acceptable abatement method to correct this hazard is to ensure drivers of the dump truck are trained and receive proper instruction in the safe operation of the dump truck, to include the training requirements needed for obtaining a commercial drivers license. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIREDATION
