Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The employer did not ensure that the individual-rung ladders inside the Ti-Brook walking floor semi-trailers were maintained and repaired in a safe and reliable manner as required by ANSI 14.3 Safety Requirements For Ladders-Fixed as follows: (a)Section 9.3.1 requires that all fixed ladder systems shall be maintained in a safe condition. Inspection for rust, corrosion and deterioration shall be made at least annually, with more frequent inspections to be made as determined by use and exposure. (Broken welds and missing rungs) (b)Section 9.3.2 requires that all bolts and welds shall be in place and secure before a ladder is used, and no ladder shall be used if any fastenings or welds are missing, (Vertical spacing) (c)Section 5.1.1 requires that all vertical spacing of the rungs from the center of the first rung throughout the length of the climb shall be uniform, (Cross section) (d)Section 5.1.3.1(4) requires that the size (cross section) of steps and rungs shall be uniform in the same length of climb.
