Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; and Employees were exposed to injuries caused by being struck by or crushed by a Komatsu tracked hydraulic excavator being used to demolish and remove a concrete bridge deck while they were engaged in work activities in close proximity to the machine. The backhoe did not have a working travel alarm which would warn them when it was placed in forward and reverse motion.
