Section 5(a)(1) of the Occupaional safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were or likely to cause death or serious physical harm to employees in that employees were exposed to a crush hazard from a lead abatement containment system failure. a)Chesapeake/Delaware Canal Bridge - Employees were in the process of making adjustments to a steel framed lead abatement containment system when a failure occurred causing the structural elements of the containment system to callapse. The employer failed to detect and correct deficiencies in the welds and the size of the U-bolts, which were used to connect each independent containment support beam. One feasible and acceptable abatement method, among others, to correct this hazard is for the employer to make an effort to ensure the conformance of the fabricated containment system with the contract drawings.
