Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by vehicular traffic. Employee working in the right lane of the westbound lanes of the four lane Grandover Parkway at the intersection of Club Road on May 1, 2001 was not provided the protection of traffic control devices as prescribed in the Manual on Uniform Traffic Control Devices. Feasible and acceptable means to correct this hazard include, but are not limited to: (1)prohibiting employees from working on the shoulder of, and in, roadways where they are exposed to being struck by vehicular traffic unless they are protected in their work zone by the use of uniform traffic control devices as prescribed in the Manual on Uniform Traffic Control Devices specific to the conditions the employees find themselves. (2)provide adequate training to insure that employees understand the need for and use of appropriate traffic control devices.
