North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being crushed by or caught between the forklift and the ground in the event of an overturn hazard. The Hyster forklift, model: H225E, serial#: B7P 66649, used for moving rolls of sheet metal at the corrugated plant, was not equipped with an Operator Restraint System (seat belt). b)being crushed by or caught between the forklift and the ground in the event of an overturn hazard. The Roanoke Hustler (Gregory) forklift, model: H-12000-C, serial#: 691S025, Type: 4039 A.D., used for loading trucks at the corrugated plant, was not equipped with an Operator Restraint System (seat belt). c)being crushed by or caught between the forklift and the ground in the event of an overturn hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have the forklifts without seat belts retrofitted, then to train employees and enforce the wearing of seat belts while operating the forklifts.
