North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall to lower level and electrocution hazard: The employer did not address the Read & Heed ! warnings in the JLG Lift Operation and Safety Handbook; 2) A malfunctioning lift shall be shut down until repaired; 3) The controls shall be plainly marked as to their function (ref. JLG Lift Operation and Safety Handbook, page 1, no. 2, no. 3, Aug. 1, 1988): a)yard - employees using JLG Lift, 40H, to perform trim work on hull of dry-docked ferries, with malfunctioning and illegible controls, while in boom basket, 20 feet above concrete landing.
