North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: 1)Employer Elton McPherson failed to furnish to each employee a temporary labor camp free from recognized hazards in that an electrical fuse box in the hall of the temporary labor camp has exposed live electrical parts and has not been repaired from a previous fire. Additionally the hot water heater and an electrical light fixture located in the kitchen of the temporary labor camp site both have exposed live electrical parts. The hazard exists that workers in the temporary labor camp will contact electricity, resulting in serious physical harm or death to migrant farm workers living in the temporary labor camp site. Among others one appropriate and feasible method of abatement is to replace or repair the electrical fuse box, the electrical light switch, and the electrical hot water heater such that all exposed live electrical parts are repaired properly.
