North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: 1)Employer Michael Layman failed to furnish to each employee a temporary labor camp free from recognized hazards in that an electrical light fixture in the female bathroom of the temporary labor camp is pulled loose from the ceiling with live electrical parts exposed. Additionally the stairs leading to the upper barn area sleeping rooms are inadequate with no hand rails and poor construction. Finally the cooking stove used in the kitchen of the temporary labor camp is an outdoor propane stove not approved by the manufacturer for indoor use. The hazard exists that workers in a wet location, the female bathroom of the temporary labor camp will contact electricity, workers entering or leaving from the upstairs barn sleeping area would be subject to falls, and propane or exhaust fumes from unapproved cook stove would all result in serious physical harm or death to migrant farm workers living in the temporary labor camp site. Among others one appropriate and feasible method of abatement is to reattach the electrical light fixture to ceiling of female bath room, allow no worker to enter into upstairs barn area, and install and supply approved electrical or gas stove with proper venting for use in the temporary labor camp site.
