North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)plant, batch house mixing area - employees were allowed to stand in close proximity of and reach underneath hoisted load, i.e., mixer gear box and parts, of overhead hoists and appurtenance that was not load rated. Employees used the 1-ton Budgit chain hoist to hoist and lift equipment and parts in the performance of maintenance activities. One feasible and acceptable abatement method, among others, to correct this hazard is to load rate the hoists and appurtenances to ensure that they can withstand the rated load capacity.
