North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees, conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)a fork lift truck was being used to lift workers to and from the North side of the roof of a church sanctuary, approximately 14 feet above the ground, on a 4 foot by 8 foot by 1/2 inch thick sheet of plywood which was not secured to the lift truck, and which had no standard rails. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to construct a platform designed to raise and lower workers which could be secured to the fork lift truck, and which would be equipped with a standard rail.ard
