Text For Citation: 01 Item/Group: 001 Hazard: CONFINED
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with entering a confined space: On or about March 4, 2002, an employee entering the portland cement silo was exposed to the hazard of falling 12-13 fee, being struck by chunks of portland cement, potentially being engulfed in portland cement, and occupying a potentially oxygen deficient atmosphere, due to the fact that the employer had not developed, implemented, and enforced the use of a confined space entry program. Among other methods, one feasible and acceptable method of abatement includes, but is not limited to developing implementing, and enforcing the use of a confined space entry program as specified in ANSI Z117.1-1995, American National Standard Safety Requirements for Confined Spaces.
