Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The employer did not provide police officers with an adequate communications system from at least February 1, 2000 through at least October 4, 2000, exposing officers to potential serious injury or death when responding to calls. Because law enforcement is a high hazard profession, officers require a radio system that can provide both incoming and outgoing service with fellow officers and dispatch. The department did not establish an alternate procedure for protecting officers when their radios would not work.
