Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) On or about 5/3/00, employees were exposed to crushing injuries in the event of a fork lift tip-over accident because of the lack of the employee(s) using the restraint devices on the Toyota fork lift, Model 026FDU35, serial number 60283. Among other methods, one feasible and acceptable method would have been to ensure the required use of seat belts already installed in the unit.lled
