Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazards of falling from and/or being struck by garbage collection equipment in that on or about July 5, 2000 and in times prior thereto, employees rode on the rear steps of a Pak-Mor Rear Loader while it was operated in reverse on Stillwater Lane in Brazos County, Texas. b) The hazards of being struck by garbage collection equipment in that the employer did not install back-up alarms on garbage collection equipment such as, but not limited to the Pak-Mor truck Number 109. c) The hazards of falling from garbage collection equipment in that the employer's vehicle inspection program did not include taking out of service and repairing before placing in service, truck(s) with bent and/or damaged riding steps and missing or damaged grab handle(s) such as, but not limited to those on Pak-Mor truck Number 109. The inspection program did not include a provision to replace any caution or danger sign when it became defaced or illegible. Among other feasible and useful abatement methods one method of abatement would be to comply with ANSI Z 245.1-1984 and any subsequent revisions, to train in and monitor the performance of each employee on the safe procedures contained therein.d
