Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being struck by a lifting hook, in that, on or about 05-05-00, garbage truck Unit 404 was being operated with the lifting hook secured to a handhold. The hoist became activated and the hook broke the handhold and struck the helper riding on back of the truck, fatally injuring him. Among other feasible and acceptable methods to correct this hazard, one feasible method would be to instruct laborers to secure the hook as recommended by the manufacturer. ANSI Z245.1-1992 Mobile Refuse Collection and Compaction Equipment Safety Requirements Section 6.1 Employer responsibility, paragraph (a) Providing for instruction and training of employees in safe methods of work before assigning them to operate, clean, service, maintain, or repair the equipment. Such instruction and training shall include procedures provided by the manufacturer. The employer shall maintain records of the names of employees trained and the dates of training.
