Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazards of falls from a Grove Scissor Lift, in that employees were allowed to stand on the midrail of the guardrail system to gain additional height. The employer did not prohibit the climbing of midrails while using the aerial platform as prescribed in the American National Standard Institute (ANSI) Paragraph 7.10, subparagraph 9. Among other feasible and useful methods, one feasible method of abatement would be to instruct employees in the safe operation of scissor lifts and prohibit climbing by occupants on the midrail or top rail of the equipment.
