North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)facility, boat lifting structure- the chain hoist support structure and hoists installation were not designed to withstand the loads and forces imposed by the boats that were lifted. (Reference ASME B30.16-1993, Section 16-1.3 Paragraph 2) Among other methods, one feasible and acceptable abatement method to correct this hazard is to procure a structural engineering certification for the load rating of the structure, slings and hoists attachments.n
