Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of explosion and molten aluminum being ejected from the melting furnaces: a)Wet scrap metal was used to charge a furnace which resulted in an explosion. Among other methods to correct this hazard, one feasible and acceptable method is to segregate and identify wet scrap so that it is readily distinguishable from the dry scrap and ensure that employees are trained in the placement and identification of wet material, and that they are aware of the hazards associated with charging with wet material. b)Wet scrap metal was not segregated from the dry scrap that was available for re- melt by a means that made it readily distinguishable from the dry scrap. c)Scrap metal that was wet was not identified as such with a securely affixed sign or other means that would make its condition readily known. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
