Text For Citation: 01 Item/Group: 001 Hazard: UNAPEQUIP
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to LP gas cylinders that had not been inspected in over ten years and had obvious physical damage rendering them unsafe: a) In that one LP gas cylinder had a dent at the shoulder causing a deformation exceeding 1/4 inch. b) In that one LP gas cylinder had a dented, deformed and rusted foot making it difficult to stand upright. c) In that four LP gas cylinders had not been inspected for safety defects within the last ten years, with some not inspected for over 35 years. d) Required markings stamped on the cylinders were partially obscured by spilled tar and other material causing them to be illegible. While the ultimate responsibility for correcting hazards rests with the employer, given his/her superior knowledge of the workplace, feasible and acceptable methods to correct this hazard, among others, include: 1) Submit pressurized gas cylinders to an authorized gas distributor for inspection. 2) Train and license company personnel to perform pressurized gas cylinder inspections. 3) Cease ownership of pressurized gas cylinders and use cylinders from authorized distributors which have passed safety inspections.
